This morning at 10 AM, one of the defendants in the Rockville High School rape case, Jose Montano, age 17, was scheduled for a felony dismissal trial in the District Court for Montgomery County. At that time, the sex assault case against him was dropped.
Montano was being charged as an adult. His case is now listed as closed and online court records indicate the defendant has been released.
The Washington Post reports that last night prosecutors told a lawyer for Henry Sanchez Milian, 18, that they would drop his sex assault case as well. Sanchez has a trial for dismissal scheduled on May 12, 2017.
The arrest of these two students after accusations were made by a 14-year-old freshman at Rockville High School garnered national attention and most of it was filled with hatred and threats due to the immigrant status of the defendants.
Lawyers for both defendants have been stating that they were innocent because the sex in the school bathroom was consensual and they had texts and photos to prove it.
